Legal Guardian Authorization
This document records a legal guardian's authorization for an adolescent to use SpotSB, defines the scope of that authorization, and explains how it may be reviewed or withdrawn.
1. Service operator
SpotSB is operated by SpotSB Co., registered in Brazil under CNPJ No. 00.000.000/0001-03, with its registered address at Curitiba, Paraná, Brazil.
2. Nature of this authorization
This document records the authorization granted by a parent, guardian, or other legal representative for an adolescent to use SpotSB features within the limits described here. It supplements the Terms of Use, Terms for Parents and Legal Guardians, and the platform's privacy notices.
3. Minimum age
SpotSB sets a minimum age of 13 for accounts and features intended for registered users. This authorization does not permit a person under the age of 13 to create a standard account.
4. Guardian identification
The guardian must provide the information requested during the authorization procedure. This may include their name, contact details, relationship to the adolescent, and other information needed to confirm identity and legal authority.
5. Adolescent identification
The procedure may record the adolescent's name, account, date of birth or age range, and other information strictly necessary to associate the authorization with the correct person.
6. Guardian declarations
By granting authorization, the guardian represents that they are an adult, have legal capacity, hold legitimate legal responsibility for the adolescent, have provided accurate information, and understand the applicable use and privacy conditions.
7. Basic scope of authorization
Basic authorization permits account creation and maintenance, authentication, security, essential settings, use of age-appropriate features, and processing of the information needed to provide and protect the service.
8. Separate optional permissions
Basic authorization does not automatically include a public profile, precise location, check-ins, public media sharing, promotional communications, or personalized advertising. Where applicable, these features must have their own controls and separate choices.
9. Public profile
If this feature is available, the publication of a profile visible to others must be clearly disclosed. The guardian and adolescent should be able to review which information will be public before activation.
10. Location, maps, and check-ins
Access to precise location, check-ins, or location sharing must depend on specific permission where required. Home, school, routine, frequent travel routes, and real-time location should not be unnecessarily disclosed.
11. Photographs, videos, and voice
The publication of photographs, videos, or voice recordings must respect available settings, third-party rights, and community rules. The guardian should instruct the adolescent not to publish intimate or sensitive content, or content that may reveal security-related information.
12. Content and community participation
When authorized and available, the adolescent may register spots, publish content, and participate in age-appropriate community features. Content will remain subject to SpotSB's conduct, moderation, and protection rules.
13. Cookies and optional technologies
This authorization does not replace choices made through the cookie preferences panel. Preferences, analytics, and marketing remain subject to the specific options presented to the user or guardian.
14. Marketing and promotional communications
Authorization to use the platform does not constitute consent to marketing, personalized advertising, or promotional communications. These uses will require a separate choice if they are introduced.
15. Sensitive personal data
This authorization does not permit indiscriminate collection of sensitive personal data. Medical, biometric, financial, complete identity document, or other high-risk information may be processed only when strictly necessary, clearly disclosed, and supported by an appropriate legal basis.
16. Supervision and guidance
The guardian agrees to guide the adolescent regarding password protection, physical safety, location exposure, interactions with strangers, content sharing, respect for property, and appropriate platform use.
17. Skateboarding safety
SpotSB does not supervise sessions, events, or the condition of locations. The guardian must assess the risks of the activity, the adolescent's level of experience, environmental conditions, and the need for protective equipment.
18. Sharing with service providers
Necessary information may be shared with providers of infrastructure, authentication, security, storage, communications, maps, and support, as described in the privacy notices. SpotSB does not sell personal data relating to adolescents or guardians.
19. International transfers
Some providers may process data outside Brazil. In these situations, SpotSB will adopt contractual, technical, and organizational safeguards consistent with applicable law and the special protection required for children and adolescents.
20. Authorization record
SpotSB may record the document version, date, time, associated account, confirmation method, authorization status, and technical information required to demonstrate that the procedure was completed.
21. Validity period
Authorization remains valid until it is withdrawn, replaced by a new version, is no longer required, or another condition disclosed by SpotSB occurs. We may request renewed confirmation following material changes or when the guardian relationship needs to be updated.
22. Withdrawal of authorization
The guardian may withdraw authorization through the official channels. Withdrawal may restrict features or require suspension or closure of the adolescent's account, without invalidating processing lawfully carried out before the request.
23. Retention after withdrawal
Even after withdrawal, certain records may be retained to comply with legal obligations, demonstrate the authorization previously granted, prevent fraud, protect the adolescent, or allow the exercise of legal rights.
24. Rights of the adolescent and guardian
The adolescent and legal guardian may exercise applicable rights of access, correction, information, objection, anonymization, blocking, deletion, and review of automated decisions. SpotSB may verify the requester's identity and legal authority.
25. Moderation and protection
Authorization does not prevent SpotSB from removing content, restricting features, or suspending an account when necessary to protect the adolescent, comply with the law, or respond to violations of community rules.
26. Material changes
If a change materially expands the purposes, data processed, or risks to the adolescent, SpotSB may request renewed authorization before making the affected feature available.
27. Authorization statement
I confirm that I have read and understood the applicable documents, that I am the legal guardian of the adolescent identified in the procedure, and that I authorize their use of SpotSB within the basic scope described in this document. I understand that optional permissions must be considered separately and that this authorization may be withdrawn.
